Hon'ble Piyush Agrawal,J. At the very outset, learned Standing Counsel raises a preliminary objection with regard to maintainability of the writ petition and submits that by the impugned order dated 19.2.2025, the matter has not been decided on merit however as the quantum of present dispute is more than 25 lakhs therefore, the jurisdiction lies with the Board of Revenue. Learned counsel for the petitioner does not dispute the said fact and wants to withdraw the present writ petition at this stage with liberty to take recourse the remedy available under the law. In view of the above, the writ petition is dismissed as with withdrawn at this stage. However, it is provided that in case the appeal is preferred within a period of 15 days from today, the same shall be entertained without raising any objection with regard to the limitation. Certified copy of the impugned order shall be returned after retaining its photostat copy. It is made clear that the dismissal of this writ petition will not affect the rights of the petitioner to take recourse the remedy available to them under the law.
