1. Heard Mr. Mohit Prakash, learned counsel for the appellant as well as learned A.P.P.
2. This application has been directed against the order dated 04.07.2025 passed in B.P. No. 364 of 2025 arising out of Raidih P.S. Case No. 23 of 2025 by the learned Additional Sessions Judge-I-cum-Special Judge, Gumla, whereby and whereunder the prayer for bail of the appellant has been rejected.
3. It has been alleged that sometime in December, 2004, the daughter of the informant had gone to Delhi and subsequent thereto, the informant was not able to contact his daughter leading to institution of the First Information Report.
4. It has been submitted by learned counsel for the appellant that one of the co-accused Ashu Kumari has been granted bail by this Court in Cr.A (D.B) No. 1124 of 2025. Learned counsel adds that the matter was compromised between the parties and consequent to the same the victim as well as the informant have been declared hostile by the prosecution. Learned counsel further adds that the appellant is in custody since 22.05.2025.

5. Learned Additional Public Prosecutor though has opposed the prayer for bail of the appellant, but has not disputed the aforesaid facts.
6. Regard being had to the aforesaid, we while setting aside the order dated 04.07.2025 passed in B.P. No. 364 of 2025 arising out of Raidih P.S. Case No. 23 of 2025 by the learned Additional Sessions Judge-I- cum-Special Judge, Gumla, direct the appellant to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount, to the satisfaction of learned Judicial Magistrate-1st Class, Gumla.

8. Accordingly, this appeal stands allowed and disposed of.
