The applicant has preferred this application under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of Bail, apprehending his arrest in connection with Crime No. 27/2025, registered at Police Station – GRP, Bhilai, District – Durg (C.G.) for the alleged commission of offence punishable
2 under Sections 305(c), 3(5), 317(5), 336(3), 340(2), 338 of the Bhartiya Nyaya Sanhita, 2023.
2. The story in brief is such that the complainant Hina Patel along with her husband on 04.04.2025 was travelling in Shivnath Express at coach no. H/A/1 Birth no. 21n from Gondiya to Raipur. The complainant was carrying a hand purse in which a necklace of diamond worth Rs. 35,00,000/-, 04 finger rings worth Rs. 4,15,000/-, cash of Rs. 45,000/- and one lady bag which was worth Rs. 20,000/-. It was alleged that all the ornaments including cash was stolen by the applicant and one co-accused. Thereafter on the basis of memorandum of the co-accused one necklace of diamond, 06 pieces of stone in green and blue color, bracelet of diamond and one oppo mobile has been seized from the accused persons and on the basis of the memorandum of the co-accused the present applicant has been arrested in the present crime.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. The applicant has no previous criminal antecedent. He submits that there are four accused persons and Santosh Rai is the main accused in the present crime. There is no transaction of
3 money in the account of the present applicant. Therefore, he prays for grant of bail to the applicant.
4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the present applicant is involved in the case, therefore, he is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the nature and gravity of the offence and material on record in the case diary, it is apparent that the recovery of ornaments has been made from the co-accused and recovery of Rs. 10,000/- has been made from the present applicant. But considering the fact that he along with other co- accused committed robbery in a first class AC compartment of the train, shows that the offence is serious in nature, and therefore, I am not inclined to grant bail to the applicant.
7. Accordingly, the bail application of the applicant –Abdul Mannan, involved in Crime No. 27/2025, registered at Police Station – GRP, Bhilai, District – Durg (C.G.) for the alleged commission of offence punishable under Sections 305(c), 3(5),
4 317(5), 336(3), 340(2), 338 of the Bhartiya Nyaya Sanhita, 2023, stands rejected.
8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously.
