Neutral Citation No. - 2025:AHC:82411 Court No. - 6 Case :- WRIT - A No. - 13267 of 2020 Petitioner :- Ishrawati Devi Respondent :- State Of U.P. And 5 Others Counsel for Petitioner :- Seemant Singh,Shantanu Khare,Sr. Advocate Counsel for Respondent :- C.S.C.,Shyam Krishna Gupta Hon'ble Saurabh Shyam Shamshery,J. 1. Heard Sri Seemant Singh, learned counsel for petitioner and Sri Lal Mani Singh, learned counsel for respondents. 2. Petitioner, after having service of about 25 years, has suffered with a show cause notice that her BTC certificate was forged and accordingly, an inquiry was initiated. 3. It appears that petitioner, despite an opportunity, has not able to place her stand, therefore, concerned respondents, on basis of inquiry report, it was held that roll number allotted to petitioner and mentioned in BTC certificate was allotted to some other candidate. 4. Learned counsel for petitioner submits that this writ petition is essentially silent on this aspect, however, it is a case of petitioner that procedure prescribed under relevant Rules were not followed and she has been unsuited after about 2 ½ decades. 5. Learned counsel also refers that this Court vide order dated 22.01.2022 stayed recovery of any past payment as mentioned in impugned order. However, petitioner is not working. 6. Learned counsel for respondents has supported impugned order that despite an opportunity, petitioner has not come forward to place her stand that her BTC certificate was not a forged document. 7. I have considered above submissions and considering that petitioner was unsuited after about 2 ½ decades and though writ petitioner has not come up with any document that findings returned in impugned order was perverse so far as allotment of roll number of BTC to some other persion is concerned. 8. Still in case petitioner has some documents in support of her claim that her certificate was genuine and she is able to produce the same before concerned respondents, therefore, an opportunity is granted to petitioner to submit relevant documents before concerned respondents within 8 weeks which will be considered in accordance with law. 9. Writ petition stands disposed of with above observations and liberty. Order Date :- 17.5.2025 Sinha_N. Digitally signed by :- NIRMAL SINHA High Court of Judicature at Allahabad
