The mother and father of the deceased pre-deceased him. The testator is survived by 3 legal heirs (wife, son and daughter). The only son who is the executor in the Will has applied for the grant. The other two heirs have consented to the grant by filing Affidavits of Consent. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, the application for grant of probate is allowed by passing orders in terms of prayer (a) of the application.
