This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No.852/2024 registered at Police Station Supela, Distt. - Durg (C.G.) for the offence punishable under Sections 109 & 112 of the Bhartiya Nyaya Sanhita, 2023. Case of the prosecution, in brief, is that at the night of 05.08.24, Umesh Kumar Verma, son of Naresh Verma, who works as a manager at the premium liquor store Akashganga Supela, after closing the shop and doing the accounts, was going to his home Krishna Nagar on his motorcycle at around 01:00 in the night, when 03 unknown boys blocked his way and attacked him with a sharp knife with the intention of killing him, due to which he got injured. The applicant was arrested on 01.09.2024 by the police of Police Station Supela, Distt. Durg (C.G.) for the alleged offence punishable under Section 109 & 112 of B.N.S.S. Act 2023. 3. Learned counsel for the applicant submits that the first bail application of the applicant was rejected by this Court on merits vide order dated 15/04/2025 in MCRC No.1156/2025. The new ground which has been raised in this second bail application is that co-accused Raj Manikpuri @ Raja @ Kaushal Das Manikpuri has been granted regular bail by this Court in MCRC No.3203/2025 on 25/04/2025, hence the applicant is entitled for grant of bail. 4. On the other hand, learned State counsel opposes the bail application and he would submit that the applicant has two criminal antecedents one under the Arms Act and another under the IPC. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected on merits by this Court vide order dated 15/04/2025 in MCRC No.1156/2025. The new ground which has been raised in this second bail application is that co-accused Raj Manikpuri @ Raja @ Kaushal Das Manikpuri has been granted regular bail by this Court in MCRC No.3203/2025 on 25/04/2025, but from the perusal of order of the co-accused goes to show that the bail application of the applicant which was rejected by this court on 15/04/2025 in MCRC No.1156/2025 was considered by the Court while granting bail to the said co-accused, hence there is no new ground to entertain this second bail application. 7. Accordingly, the second bail application of the applicant-Shailesh Sinha, involved in Crime No.852/2024 registered at Police Station Supela, Distt. - Durg (C.G.) for the offence punishable under Sections 109 & 112 of the Bhartiya Nyaya Sanhita, 2023 is rejected. 8.
