The Court:- This is an application for grant of probate of the last Will and Testament dated January 4, 2021 left behind by the above-named deceased. The testator died at ripe age of 93 years on March 02, 2021. His wife and his only daughter predeceased him. The only legal heir being his grandson has been described in paragraph 6 of the application. The testator’s son-in-law is the executor and the applicant. The testator’s grandson (being the only legal heir) has consented to the grant by filing affidavit of consent. The Will has been proved in common form by one of the attesting witnesses. Having regard to the above and since the file has been placed before this Court by the Registrar Insolvency for grant, upon complete scrutiny by the department, therefore, considering the view of the department, this application for grant of probate is allowed by passing orders in terms of prayer (a) of the petition.
