--- 03/06.10.2025 Both these Bail Applications arise out of same police case. Accordingly, both these Bail Applications are being disposed of by a common order. Heard the parties. The petitioners have been made accused in connection with Pratappur P.S. Case No. 141 of 2024, for the offences registered under Sections 140(1), 3(5) of the B.N.S., 2023 subsequently Section 103(1) of the B.N.S. has been added, pending in the court of learned Sub-Divisional Judicial Magistrate, Chatra. On 14.12.2024 at about 7:00 P.M., son of the informant namely Vikash Kumar was abducted by the named accused persons and thereafter, he was found murdered. It was submitted that though the petitioners are named in the F.I.R., but the informant is not eye witness to the occurrence. Learned A.P.P. submitted that on the basis of confession of the petitioner Vishwnath Bharti murder weapon was recovered from the house

of co-accused. However, it was submitted that apart from confession, there is no other material against the petitioner Santosh Bharti @ Pagla. In view of the aforesaid facts, I am not inclined to release the petitioner Vishwnath Bharti, on bail. Accordingly, his prayer for bail stands rejected. As far as the petitioner Santosh Bharti @ Pagla is concerned, I am inclined to enlarge the petitioner Santosh Bharti @ Pagla on bail. Accordingly, the petitioner Santosh Bharti @ Pagla is directed to be released on bail on furnishing bail bonds of Rs.
20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Chatra, in connection with Pratappur P.S. Case No. 141 of 2024. (Ambuj Nath, J.) Jay/-
