Mr. Yogesh Pant, learned counsel present for the petitioner. 2. Mr. Lalit Sharma, learned Central Government Standing Counsel present for the Union of India/respondents. 3. Vide order dated 07.03.2025, learned counsel for the respondents was directed to seek instructions in the matter within ten days. The writ petition was filed by mother of one person, named Suraj Saxena, who died during the recruitment of the ITBP at Halduchaur. The case was proceeded allegedly against the ITBP Officials who were later on convicted by the General Force Court of ITBP as per annexure-1 to the writ petition and the conviction order was sent for confirmation to the Deputy Inspector General, ITBP Delhi. The Deputy Inspector General remanded the matter for reconsideration, but since then, no final decision was taken, according to the learned counsel for the petitioner. 4. Today, learned counsel for the respondents supplied the instructions along with the order of the Hon’ble High Court of Delhi at New Delhi passed in W.P.(C) 17055/2024, CM APPL.72325/2024, Shailendra Kumar Yadav vs. Union of India & others, passed on 10.12.2024 and submitted that after the remand of the matter for reconsideration, the remand order dated 07.07.2023 was challenged before the Delhi Court and the Delhi Court has been pleased to stay the proceedings before the General Force Court, pursuant to the order dated 07.07.2023. 2 5. In view of the aforesaid reasons, learned counsel for the petitioner seeks permission to withdraw the present writ petition. 6. The prayer, so made, is granted. 7. The present writ petition is dismissed as withdrawn. However, the liberty is given to the petitioner to approach this Court or any other appropriate Forum, if cause of action survives later on.
