Neutral Citation No. - 2025:AHC:47320 Court No. - 80 Case :- APPLICATION U/S 529 BNSS No. - 660 of 2025 Applicant :- Faeem Alias A.T.M. Opposite Party :- State of U.P. Counsel for Applicant :- Abhay Mishra Counsel for Opposite Party :- G.A. Hon'ble Nalin Kumar Srivastava,J. 1. This application under Section 529 BNSS has been filed with a prayer to direct the court concerned to decide the proceedings of Case Crime No.242 of 2014 (State Vs. Faeem alias A.T.M. and others) under Sections 328, 392, 411 IPC, Police Station Collector Bukganj, District Bareilly pending in the Court of Addl. Chief Judicial Magistrate, Court No.2, Bareilly, expeditiously within a stipulated period. 2. Heard learned counsel for the applicant as well as learned A.G.A. for the State. 3. The applicant before this Court is one of the accused persons in the aforesaid case. He is languishing in jail in some other matter but surprisingly there are several order-sheets which reveal that non-bailable warrant has been issued against the present applicant for want of his appearance before the court. It is surprising that since the applicant has averred before this Court that he is languishing in jail, how the learned trial court issued non-bailable warrant against him instead of sending process to the concerned Jail Superintendent. 4. In these circumstances, the Court concerned is directed to frame charge in this case as per law within a period of two months from the date of production of certified copy of this order before it and thereafter all possible endeavours shall be made by the Court concerned to expedite the trial of the case and to conclude it expeditiously without granting any unnecessary adjournment to either of the parties. 5. It is also made clear that the Court / Presiding Officer is not the only stake holder in the trial and disposal of a case, hence, besides the P.O. concerned, all the stake holders i.e. police and executive authorities, counsels, parties to the case, staff etc. are also made bound by this order and it will be their responsibility also to assist the Court in every manner for the expeditious disposal of this case. 6. With the above observations, the application stands disposed of.
