This Petition is filed on behalf of the Petitioner under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ( for short ‘ BNSS, 2023) to release the Petitioner on bail in connection with Crime No.550 of 2024 of P.M. Palem Police Station, Visakhapatnam District. 2. The Petitioner is the Accused No.2. A crime was registered against the Petitioner for the offences under Sections 20 (b) (ii) r/w 8 (c) of the NDPS Act, 1985. 3. As per the case of the Prosecution, the Petitioner along with other accused was found in possession of 3.5 kgs of Hash Oil/Weed Oil and were arrested on 20.09.2024. 4. Heard Sri Pangi Raju Babu, learned counsel for the Petitioner, and the learned Assistant Public Prosecutor appearing for the Respondent-State. 5. The counsel for the Petitioner submitted that as the Petitioner is under arrest from 20.09.2024, he sought for bail. It was also fairly submitted that a similar bail application filed by the Petitioner was dismissed as withdrawn on 05.12.2024. 6. The learned Assistant Public Prosecutor opposed the bail petition on the ground that the quantity, which was seized from the Petitioner, is a commercial quantity, and the investigation is still in progress and that other accused are yet to be arrested. 7. As the investigation in this case is yet to be completed and other accused are yet to be arrested and as there is no change in the circumstances, this Court is not inclined to grant bail at this stage. 3 8. Accordingly, the Criminal Petition is dismissed.
