PUBLIC PROSECUTOR ...RESPONDENT/COMPLAINANT The Court made the following: TV THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY CRIMINAL PETITION NO.9140 of 2024 ORDER: The present Criminal Petition is filed under Section 482 of B.N.S.S, 2023 to release the Petitioners/Accused Nos.9 to 11 on bail in the event of their arrest in connection with Cr.No.168 of 2024, dated 28.10.2024 of Krosuru Police Station, Palnadu District, registered for the offence punishable under Sections 109(1), 118(1), 333 R/w 3(5) of B.N.S. Act, 2023. 1. The Petitioners herein are the Accused Nos.9 to 11 in the 2. above crime. Heard Sri Kambhampati Ramesh Babu, learned counsel for the Petitioners and the learned Assistant Public Prosecutor appearing for the Respondent-State. 3. The learned Assistant Public Prosecutor opposed the bail petition on the ground that the presence of Petitioners/Accused Nos.9 to 11 is required for further investigation. 4. 5. Perused the record. The allegation of the prosecution is that on 27.10.2024 when the de facto complainant and her father were at their house, A.2 to A. 14 trespassed into their house, searched for the husband of the de facto complainant, tried to kill them and hurled chilli powder into their eyes. The husband of the de facto complainant Mahboob Basha was killed in the attack. The attack was said to be a pre-planned one and on account of property disputes, A.1, A.3 to A.13 were said to be carrying deadly 6. i 2 weapons like sticks and iron rods, among them A.3, A.4, A.5 & A.6 attacked the de facto complainant’s father and caused severe bleeding injuries. Later, the injured were shifted to G.G.H, Guntur for treatment. There are allegations in the remand report about the Petitioners’ involvement from the stage of planning the attack to actually attacking L.W.7. Basing on the complaint given by the de facto complainant, the present crime was registered for the above said offences. The anticipatory bail application was dismissed by the IV Additional Sessions Judge, Guntur in Crl.M.P.No.1208 of 2024 on 27.11.2024. Hence, the present Criminal Petition is filed before this Court. 7. According to the learned Assistant Public Prosecutor, the investigation in this case is yet to be completed. Since the investigation is pending and as there are serious allegations against the Petitioners, this Court is not inclined to grant anticipatory bail to the Petitioners.
