IN THE HIGH COURT OF ORISSA AT CUTTACK
W.P. (C) No.14821 of 2025
Subal Baral & others …. Petitioners
Mr. M.K.Rath, Advocate
-Versus-
State of Odisha and others …. Opposite Parties
Mr. P.K.Ray, AGA
CORAM:
MR. JUSTICE R.K. PATTANAIK
Order No.
ORDER 17.06.2025
01.
1. Heard Mr. Rath, learned counsel for the petitioners and Mr. Ray, learned AGA for the State.
2. No notices issued to opposite party No.4 as the matter is disposed of at the stage of admission.
3. Instant writ petition is filed by the petitioners for a direction to opposite party No.2 to consider representation filed by them as per Annexure-3 dated 6th January, 2025 seeking allotment of shop rooms premises of OSRTC bus stand on the grounds stated.
4. Mr. Rath, learned counsel for the petitioners submits that the petitioners were in occupation of the shop rooms and in the year 2015, lease agreement was executed individually but
for the expansion of the bus stand, notice was issued in 2024 and all of them vacated the same as a result. The further submission is that in the meantime, the new bus stand has been constructed and there the shop rooms are available for being allotted and therefore, the petitioners should be rehabilitated and in that regard, the representation i.e. Annexure-3 is pending decision of opposite party No.2.
5. Recorded the submission of Mr. Ray, learned AGA for the State.
6. Since the limited grievance of the petitioners is for disposal of the representation vis-à-vis allotment of the new shop rooms inside the OSRTC premises, the Court is of the view that opposite party No.2 should be directed accordingly to take a decision thereon at the earliest as the same would serve the purpose and meet the ends of justice.
7. Accordingly, it is ordered.
8. In the result, the writ petition stands disposed of with the direction as aforesaid to be complied with by opposite party No.2 disposing of the representation dated 6th January, 2025 i.e. Annexure-3 at the earliest preferably within a period of two weeks from the date of receipt of a copy of this order and if necessary, upon providing an opportunity of personal hearing to all of them.
9. Urgent certified copy of this order be issued as per rules.
