1. Heard Mr. R.K. Kesharwani, learned counsel for the petitioner. Also heard Mr. Soumya Rai, learned Panel Lawyer for the respondents/ State.
2. The petitioner has filed this petition praying for following relief:-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to quash the impugned FIR bearing crime no. 567/2018 dt. 22/11/2018 offence u/s 420 IPC and impugned charge-sheet (Challan) no. 269/2022 dt. 15/07/2022, this is pending for trial before the learned Chief Judicial Magistrate, Dhamtari bearing 265/2023 along with the order taking Criminal Case no. cognizance of the offence in the ends of justice.”
3. At the time of hearing, this Court has observed that the petitioner has filed the present petition without appropriate prayer which is defective one, therefore, we are not inclined to entertain the present petition with such a vague and sketchy prayer as date of
order taking cognizance has not mentioned to which learned counsel for the petitioner seeks permission of this Court to withdraw the present petition with liberty to file afresh with proper prayer.
4. Learned State counsel has no objection.
5. In view of the submissions made by learned counsel for the petitioner, the present petition is dismissed as withdrawn with the aforesaid liberty, as prayed for subject to depositing a sum of Rs. 2,000/- as cost by the petitioner in the Registry of this Court for wasting precious time of the Court and the said amount shall be
3 transmitted to the Government Multi-Disabled Home, Village Pendri, District- Janjgir- Champa (C.G.).
