This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with Deoghar Town P.S. Case No.610 of 2023, for offences under Sections 406 and 420 IPC. The case is presently pending before the Court of learned C.J.M., Deoghar.

There is an allegation that the petitioner is not transferring the School to the informant though the petitioner has taken huge amount.

The petitioner denies the aforesaid allegation and submits that the petitioner himself has invested Rs.4 crore and has also given Rs.68 lac to the informant’s side also, still then the case has been filed to grab the entire property.

The F.I.R. is lodged under Section 406 and 420 IPC, where the punishment is for seven years or less.

There is nothing on record to suggest that there is an eminent threat of the petitioner being arrested.

Learned A.P.P. submits that notice under Section 41 A Cr.P.C. / Section 35(3) of the BNSS was issued to the petitioner and the petitioner appeared and handed over all the papers to the
2025:JHHC:13458 Investigating Officer. The Investigating Officer did not feel it necessary to arrest the petitioner.

The submission of learned A.P.P. clearly suggests that the petitioner is cooperating with the investigation.

Since the petitioner is cooperating in the investigation, there is nothing to suggest that the petitioner will be arrested. Thus, I direct the petitioner to appear before the learned Trial Court.
10. With the aforesaid observation, this Anticipatory Bail Application stands disposed of.
