1. This writ petition has been filed by the petitioner challenging the order dated 11.09.2024 passed by Central Administrative Tribunal, Jaipur Bench, Jaipur. 2. Being aggrieved by the transfer order dated 25.06.2024, the petitioner filed the original application No.348/2024 before the
[2025:RJ-JP:33074-DB] (2 of 3) [CW-19736/2024] Central Administrative Tribunal, Jaipur Bench, which was disposed of by the Tribunal vide its order dated 03.07.2024. 3. The respondents considered the representations submitted by the petitioner against the transfer order and rejected the same vide order dated 29.08.2024 against which the petitioner again filed original application No.516/2024 before the Central Administrative Tribunal, Jaipur Bench which was dismissed by the learned Tribunal. 4. Learned Tribunal while dismissing the O.A. filed on behalf of petitioner observed as under:-
“Shri Hawa Singh, learned counsel for the applicant put in appearance on behalf of the respondents and states that the applicant had given 5 choice stations out of which the 3rd choice station i.e. Hanumangarh has been accepted and the applicant has been posted to his choice station.
As to the grievance of the applicant qua Shri Ravi Kumar who has been posted at KV No. 3, Jaipur, the respondents while deciding the representation of the applicant have stated that he was earlier posted at hard station in Assam (Tinsukia Region) since 20.09.2014 and subsequently at KV, AFS, Chabua w.e.f. 29.09.2023 which again is a hard station and the same falls in Tinsukia Region, accordingly, grudge of the applicant against Shri Ravi Kumar is not sustainable. Bare perusal of the order dated 29.08.2024, we find that the respondents have dealt with the grievances of the applicant at length properly and have also accepted his request to the extent that they have posted him to the 3rd station in the order of the choice given by him. We find no infirmity in the impugned order. Accordingly, the O.A. is dismissed. No costs.”
5. We are satisfied with the order dated 11.09.2024 passed by the Tribunal. Admittedly, respondents sought five choice stations from the petitioner out of which the petitioner has submitted his choice and in response to the said request, the respondents have posted the applicant at his third choice station i.e. Hanumangarh. [2025:RJ-JP:33074-DB] (3 of 3) [CW-19736/2024]
6. In our considered view, no illegality has been committed by the respondents in posting the petitioner at Hanumangarh. We are also of the considered view that an employee cannot ask the employer to post him at a particular place of his choice. 7. In that view of the matter no case is made out for interference. Hence, this writ petition is dismissed. (BHUWAN GOYAL),J (INDERJEET SINGH),J PAYAL DHAWAN /99
