This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the State-Petitioner. Perused the application as well as the prayer made therein. 3. The present application has been filed under Section 378(1) (3) of the Cr.P.C. for grant of leave to prefer an appeal against the judgment of acquittal dated 23.10.2006 passed by the learned J.M.F.C., Sambalpur in C.T. Case No.1082 of 2004. 4. On perusal of the judgment it appears that the accused has been acquitted by the learned J.M.F.C., Sambalpur passing a reasoned order. Although the present leave application was presented in the year 2007, however, till date no steps have been taken to remove the defects pointed out at the time of filing the present application. Moreover, it appears that there exists a delay of 110 days. Since 2007 no notice has been issued to the Opposite Page 2 of 2. Party in the limitation matter. 5. In such circumstances, this Court is not inclined to entertain the present application and the same is dismissed on the ground of latches by the State-Petitioner. ( A.K.
