---- 2/15.10.2025 Heard learned counsels for petitioners and for State.
2.
The petitioners are apprehending their arrest in connection with Chas PS Case No.35 of 2025, for offence registered under section 329(4), 308(3), 303(2) and 3(5) of BNS, 2023, pending in court of learned Chief Judicial Magistrate, Bokaro.
3.
Learned counsel for petitioners submits that part of the joint property has been sold by the informant and the informant kept his belongings there and allegation is made that when he returned from ancestral house, the petitioner and others stopped him from entering into the house. There is allegation that they have also stolen some property. He further submits that four coaccused persons have been granted anticipatory bail in ABA No.3235 of 2025.
4. Learned State counsel opposes prayer and submits that allegations are there of stealing of certain property.
5. Considering above it appears that the joint property is in dispute between the parties and prima facie it transpires that the matter is arising out of civil nature and the co-accused has been granted anticipatory bail, I am inclined to grant anticipatory bail to petitioners.
6. Accordingly, petitioners, above named, are hereby directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, both the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Chief Judicial Magistrate, Bokaro, in connection with Chas PS Case No.35 of 2025, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
