VENKATESWARLU NIMMAGADDA 2 The Court made the following Order: This Writ Petition is filed under Article 226 of the Constitution of India for the following relief/s:- “…issue a writ, order or direction more particularly one in the nature of Mandamus declaring the action of the 3rd respondent in issuing the tender notification in Tender ID 207456,Tender Notice Number 158/2016-F1 without exempting the petitioner society from payment of Earnest Money Deposit (EMD) and without reserving at least 15% or more of all the works including sanitation works in the 3rd respondent Municipality to the Petitioner Society as illegal, arbitrary and violative of Art 14 and 21 of Constitution of India and opposed to the provisions of A.P.Municipal Tender Rules 3(2), 5(2), 8(3), G.O.Ms.No.475 MA and UD dt 28.8.1989, G.O.Ms.No.581, dt 06.07.1986, G.O.Rt.No.269 MA, dt 07.04.1998 and G.O.Ms.No.30 MA and UD (G.II) dt 18.01.2000 and pass such other order or orders…” 2. In view of passage of time and due to changed circumstances, the cause in this writ petition does not survive. 3. Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
