By the present writ petition, the petitioner is seeking for the following reliefs :- “10.1 That this Hon'ble Court may kindly be pleased to set-aside the impugned disproportionate punishment order dated 06.06.2019 (Annexure P/1) passed against the petitioner by respondent No. 3 without having jurisdiction and further may kindly be pleased to direct the respondent authorities to forthwith release pensionary benefits to the petitioner with all consequential benefits along with interest. 10.2 That this Hon'ble Court may kindly be pleased to direct the respondent authorities to forthwith release the amount of unpaid retiral dues in favor of the petitioner with interest @ 12% from the date it becomes due till the date of actual payment. 10.3 That, any other relief/order which this Hon'ble Court may deem fit and just in the facts and circumstances of the case including the cost of the petition may kindly be awarded to the petitioner.” 2. Learned counsel appearing for the State by referring their return, would submit that the impugned order 06/06/2019 (Annexure P/1) passed by the SDO (Revenue), Ramanujganj has been recalled vide order dated 25/02/2025 (Annexure R/1) passed by the SDO and as far as the payment of retiral dues is concerned, the respondent authorities have issued a communication dated 04/02/2025 (Annexure R/2) to the Divisional Joint Director, Treasury, Accounts and Pension, Surguja Division which is under process, therefore, there is nothing remains to be adjudicated in the present writ petition. 3 / 3 3. I have heard learned counsel for the parties, perused the documents as well the reply/return submitted by the State. 4. It is categorically stated in the reply filed by the State that the pension case of the petitioner has been forwarded to the Office of Divisional Joint Director, Treasury, Accounts and Pension, Surguja Division which is the competent authority for finalizing the pension case and to settle the dispute of the petitioner. 5. In view of the above, the competent authority/ Divisional Joint Director, Treasury, Accounts and Pension, Surguja Division is directed to settle the pension case of the petitioner and the retiral dues which is to be paid to the petitioner and if the pension and retiral dues are undisputed, the same shall be released immediately to the petitioner, within a period of 20 days from the date of receipt of a copy of this order. 6. The petitioner is at liberty to apprise the concerned authority with regard to the order passed by this Court. 7. With the aforesaid direction, this writ petition stands disposed of.
