p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK W.P.(C) No.14649 of 2025 Sabita Sahu …. Petitioner Represented by Adv.– Mr. K.A. Guru, Advocate -Versus- State of Odisha and others …. Opposite Parties Represented by Adv.– Mrs. Suman Pattanayak, Addl. Govt. Advocate CORAM: HON’BLE THE CHIEF JUSTICE AND HON’BLE MR. JUSTICE MURAHARI SRI RAMAN Order No. ORDER 14.07.2025 01. 1. Without delving to go deep into the controversies having arisen and without adverting to the allegations made in the instant writ petition, we feel that the instant writ petition at the admission stage can be conveniently disposed of on the basis of the stand taken by the State. 2. The relief claimed in the instant writ petition pertains to the shifting of an IMFL OFF Shop of SBI Main Branch Chhak, Berhampur under Ward No.19 of Berhampur Municipal Corporation to Barrack Road, Old Bus Stand, Berhampur held by the opposite party No.5. p. 2 3. It is submitted by Mrs. Suman Pattanayak, learned Additional Government Advocate appearing for the State-opposite parties that the opposite party No.5 has applied for shifting of the said shop to another place and the said application is under active consideration of the competent authority. 4. In view of the facts so discerned in the course of the hearing, we do not think that it would subserve the purpose of keeping the instant writ petition pending. It is open to the authority to take a conscious decision in accordance with law. 5. The instant writ petition is thus disposed of. (Harish Tandon) Chief Justice (M.S. Raman) Judge S.K.
