Petitioners Vs The Sub Registrar No.1, Joint Sub Registrar Gobichettipalayam Erode District. .... Respondent Prayer : Writ Petition filed under Article 226 of Constitution of India praying to issue a Writ of Certiorarified Mandamus calling for the records pertaining to the Refusal Check Slip in Refusal Number RFL/1 No.Joint Sub Registrar Gobichettipalayam/9/2024 dated 09.10.2024 and to quash the same as illegal, incompetent and ultra-vires and consequently direct the respondent to register the sale agreement dated 04.10.2024 executed by the said Boopathy through his Power of Attorneys. 1/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 2/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 For Petitioner : No Appearance For Respondent : Mr.U.Baranidharan Special Government Pleader ORDER When the matter was taken up for hearing today, a memo was filed in Court by the learned counsel appearing for the petitioner to the effect that they have handed over all the papers to the petitioner and given change of vakalath. The learned counsel submitted that they are no longer appearing for the petitioner. 2. In the light of the above submissions, this Court took up the matter and proceeded to deal with the matter based on the available materials and after hearing the learned Special Government Pleader. 3. The respondent has given the written instructions and the relevant portions are scanned and extracted : 3/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 4/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 5/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 6/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 7/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 8/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 9/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 4. It is quite clear from the refusal check slip and also the written instructions given by the respondent that there were sufficient reasons for the respondent to issue the refusal check slip dated 09.10.2024 and the same does not suffer from any illegality. This is more so, because a writ petition has been filed in W.P.No.10713/2025 questioning the Power of Attorney itself and for initiating proceedings under Section 83 of the Registration Act against the petitioner herein, who has been shown as the third respondent in that writ petition. 10/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 5. In view of the above, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed. 24.03.2025 Index : Yes/No Speaking Order/Non-Speaking Order Neutral citation : Yes/No ds To: The Sub Registrar No.1, Joint Sub Registrar Gobichettipalayam Erode District. 11/12 https://www.mhc.tn.gov.in/judis W.P.No.9404 of 2025 N.
