Present criminal appeal has been filed against the judgement and order dated 23.10.2007 passed by Session Judge, Rampur in S.T. No. 252 of 2002 (State vs. Prempal and others) convicting the appellant under Section 302/149 IPC sentencing him with life imprisonment and a fine of Rs. 10,000/-, in case of default sentence of one year rigorous imprisonment and further 2 years of rigorous imprisonment for offence punishable under section 148 IPC. Both the sentences shall run concurrently. 2. As per office report dated 25.3.2025 based on the report of Chief Judicial Magistrate, Rampur dated 07.02.2025, sole appellant Waheed died on 07.12.2019. Alongwith said report, report of Sub Inspector- Subhash Chandra, Police Station Saifni, District Rampur, Statement of Yasin Ahmad-member of Kshetra Panchayat- and the statement of his son Gaffar regarding the death of the sole appellant has also been annexed. The death certificate of the sole appellant has also been annexed alongwith the report of Chief Judicial Magistrate, Rampur. 3. Accordingly, present appeal stands abated. 4. However, the record of the present appeal shall remain connected alongwith connected Criminal Appeal No. 7970 of 2007.
