Neutral Citation No. - 2025:AHC:112253 Court No. - 38 Case :- WRIT - A No. - 14806 of 2008 Petitioner :- Naipal Singh Respondent :- State of U.P. and Others Counsel for Petitioner :- Anju Shukla,Chandra Bhan Dubey,Nigamendra Shukla,Umesh Kumar Counsel for Respondent :- C.S.C. Hon'ble Donadi Ramesh,J. 1. Heard Shri Umesh Kumar learned counsel for the petitioner and learned Standing Counsel for the State-respondents. 2. The present writ petition is filed for the following relief:- "(i). Issue a writ, order or direction in the nature of a writ by certiorari quashing the impugned order dated 29.10.2007 passed by the DIOS, Bulandshahr, respondent No.4 (Annexure No.4). (ii). Issue a writ, order or direction in the nature of a writ of mandamus commanding the Deputy Director, Meerut Region, Meerut respondent no.2 to fix the pension of the petitioner by adding his services for the period from 12.06.1964 to 30.06.1971." 3. After notice the respondents have taken a specific stand that in view of challans with effect from 11.12.1964 to 30.06.1971 have been deposited through challan for which permission of the Government was necessary. The D.I.O.S is not the authority to fix the pension of the petitioner, he can only recommend the matter to the Deputy Director of Education. Learned counsel appearing on behalf of the petitioner has specifically contended that the respondent authorities have issued dues of the petitioner from 1964 to 1998 and accordingly, the petitioner has deposited the said challans, which were also annexed along with rejoinder affidavit as Annexure No.1. 4. Considering the said submissions and also perusal of the record, as the petitioner has already deposited the dues of his portion, the respondent more particularly the District Inspector of Schools may consider the case of the petitioner and recommend his case to the concerned authorities for calculation of the pension of the petitioner from 1964 to 1971. The order dated 29.10.2007 is set aside and the matter is remanded back to the concerned authorities to consider the case of the petitioner afresh. This exercise should be completed within a period of two months. If the petitioner is found eligible the difference amount may be released to the petitioner within the same period. 5. Accordingly, the present writ petition is disposed of. Order Date :- 14.7.2025 AdityaG (Donadi Ramesh,J.) Digitally signed by :- ADITYA GAUTAM High Court of Judicature at Allahabad
