This is the second attempt on behalf of the petitioner for grant of bail in connection with Majhauliya P.S. Case No. 427 of 2024 registered for the offence punishable under Sections 419, 420, 467, 468, 471, 414, 120B/34 of the Indian Penal Code and Sections 66(C), 66(D) and 66(F) of the Information Technology Act. 3. Earlier the bail application of the petitioner has been rejected vide order dated 01.10.2024 passed in Cr. Misc. No. 65591 of 2024, which reads as follows:
“Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in connection with registered for the offence punishable under Sections 419, 420, 467, 468,
Patna High Court CR. MISC. No.24695 of 2025(2) dt.09-05-2025 2/2 471, 414, 120B/34 of the Indian Penal Code and Sections 66(C), 66(D) and 66(F) of the Information Technology Act. 3. The petitioner is involved in cyber crime by using fake ATM cards and fake mobile sim cards. A huge amount has been recovered from the petitioner. Materials have come during investigation to connect the petitioner with cyber crime. 4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner. 5. Considering the fact that the petitioner is involved in cyber fraud, I am not inclined to grant bail to the petitioner. 6. Accordingly, the application stands dismissed. 7. The Court below is directed to expedite the trial.”
4. The trail has stared and one witness has already been examined. 5. In view of the law laid down by the Hon’ble Supreme Court in the case of X vs. State of Rajasthan & Anr. reported in 2024 SCC Online SC 3539, this application is dismissed. 6. The court below is directed to expedite the trial.
