This writ petition has been filed for the grant of following substantive reliefs:-
“(i) Issue a writ of mandamus directing the respondent corporation to pay the retiral benefits i.e. revised pension, Gratuity, and Commuted Value of Pension etc to the Petitioner which have accrued in his favour on account of Himachal Pradesh Civil Services (Revised Pay) Rules 2022 as well as Office Memorandum dated 25.02.2022 alongwith all consequential benefits in the interest of justice and fair play. (ii) That the Writ in the nature of Mandamus or any other appropriate writ order or directions may kindly be issued directing the Respondents to release the

- 2 - arrears on account of the delayed payment along with interest @12% per annum.”

Learned counsel for the parties are ad idem that the grievances of the petitioner and the relief claimed by him has already been considered and decided in terms of Brij Lal Lohia Vs. Himachal Road Transport Corporation and others2, with the following operative directions:-
“5. In view of the submissions made by learned counsel for the respondents, these writ petitions are disposed of with direction to the respondents to make payment of arrears accrued to the petitioners on account of revision of pension w.e.f. 01.07.2023 to 30.09.2025 within a period of 12 weeks from today. The recurring revised pension admissible to the petitioners be released positively within two weeks from today, i.e. for the month of November, 2025 to be released in the month of December, 2025. Liberty is, however, reserved to the petitioners to seek appropriate remedy for the redressal of their surviving grievances, if any, in accordance with law.”
Learned counsel for the parties submits that the case of the petitioner be also disposed of in terms of the above directions.

In view of above, this writ petition is disposed of with the observation that directions issued in Brij Lal Lohia2 shall mutatis mutandis apply to the case of the petitioner as

- 3 - well. The needful shall be carried by the respondents in the instant case keeping in view directions issued in Brij Lal Lohia2 .
Pending miscellaneous application(s), if any, also stand disposed of.
