Raghunandan Rao) Certain extents of land in Sy.No.628 of Angallu Village, Kurabalakota Mandal, Chittoor District (now Annamayya District), had been acquired for the purpose of widening of the national highway passing through the said village. The private respondents in these appeals had filed W.P.Nos.33221 and 33222 of 2023, contending that they had been assigned house site pattas in the land in Sy.No.628, which is said to have been acquired for road widening, and that no compensation had been paid to them. The private respondents relied upon the judgment of a larger Division Bench of the erstwhile High Court of Andhra Pradesh in Land Acquisition Officer-cum-Revenue Divisional Officer, Domalguda vs. Mekala Pandu and Others^ to contend that even the private respondents are entitled to compensation on par with private patta owners. It may be noted that the respondents, apart from seeking compensation, had also contended that their possession of the land in question should not be disturbed. The learned Single Judge of this Court accepted the said contention after recording the submission of the learned Government Pleader for Land Acquisition that they would follow due process before interfering with the possession and enjoyment of the property by the private respondents. The learned Single Judge of this Court, after recording the aforesaid submission, also observed that the petitioners had approached the Housing Board for financial assistance, which was still awaited. On the basis of these 2. 3. ‘ 2004(2)ALD451(LB) 12 observations, the learned Single Judge respondents are persons who took the view that the private are entitled to compensation and protection from dispossession, except in accordance with law. Thereupon, the learned Single Judge disposed of the writ petitions by separate respondents from interfering with the peaceful orders, restraining the possession and enjoyment of the property of the private procedure, and held that the respondents equivalent to that of pattadars or private property owners. 4- Aggrieved by the said orders, passed on 23.12.2023 respondents herein, without following due were entitled to compensation in the above two writ petitions, the State has filed these appeals before this Court. 5. The learned Assistant Government Pleader would contend that the private respondents herein had appearing for the appellants not been assigned any land and that the patta certificates produced by the private respondents not genuine. He would further submit that 69 are persons had been assigned the contend that it is the names of very same land on 13.08.2006. He would also these 69 persons that are recorded in the DKT Register, and there i mention of the private respondents anywhere in the DKT Register. 6. The learned Assistant Government Pleader IS no would contend that these Single Judge, and that the facts could not be placed before the learned submissions made by the learned Government record. Pleader are not based on 7. The learned Assistant Government Pleader submission of the learned Government Pleader, would also contend that the before the learned Single 13 mJ Judge, that the land was taken over for widening the road by the State Roads and Buildings Department, is incorrect, and that it is the National Highway Authority which has undertaken extension of the national highway after the land had been acquired under the provisions of the National Highways Act. He would also draw the attention of this Court to the notification issued under Section 3A of the National Highways Act, 1956. The learned counsel appearing for the private respondents would contend that the land had been assigned to the private respondents and would rely upon the patta certificates issued by the Tahsildar on 11.08.2006. The learned counsel for the private respondents would also draw the attention of this Court to the notification issued under the National Highways Authority of India Act, 1988, for the purpose of acquisition of the land in question. This notification, published in the local newspaper, records only two persons as being in possession and ownership of some extent of land in Sy.No.682/2. Learned counsel would contend that the contention of the learned Assistant 8. Government Pleader that 69 other people had been assigned lands in Sy.No. 628/2 cannot be accepted when the acquisition notification itself, published under Section 3G of the National Highways Act, 1956, mentions only two persons as being entitled to compensation in relation to the land in Sy.No.628/2. The aforesaid submissions clearly reveal that there is a dispute as to the veracity and genuineness of the patta certificates issued in favour of the private respondents. This Court cannot go into these questions, and it would 9. ' ■ 14 be appropriate that these issues be referred to a fact-finding authority for definitive ascertainnnent of the right and entitlement of the private respondents over the land. Under the circumstances, we deem it appropriate to dispose of these 10. two writ appeals by directing the Revenue Divisional Officer/Sub-Collector- cum-competent authority, Land Acquisition, Madanapalle, Annamayya District, to verify the patta certificates produced by the private respondents in these writ appeals and take a decision as to whether these patta certificates had been issued by the Mandal Revenue Officer, Kurabalakota, or not. The Revenue Divisional Officer/Sub-Collector shall also consider whether the private respondents have approached the Housing Board for loans, and take that fact into consideration while deciding whether the patta certificates produced by the private respondents are genuine or not. The Revenue Divisional Officer, after considering all facts and after 11. giving an opportunity of hearing to the private respondents, shall take a decision in this regard. Thereupon, the question of payment of compensation shall be decided. In the event of the RDO holding that the certificates produced by the private respondents are genuine, they shall be entitled to compensation in terms of the judgment of the larger bench of this Court in Land Acquisition Officer-cum-Revenue Divisional Officer, Domalguda vs. Mekala Pandu and Others. 12. As far as the question of possession is concerned, it is the admitted case that the road has been laid over the land claimed by the private r,. 15 respondents and, as such, the question of protection of possession of the private respondents would not arise. With the above directions, these Writ Appeals are disposed of. There 13. shall be no order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed.
