CONCILIATION ORDER Petitioner-accused and respondent-complainant are present duly identified by their respective counsel. 2. Heard the learned counsel appearing for the respective parties. 3. After prolonged negotiations, the matter is settled. The petitioner and the respondent along with their respective counsel have filed the joint memo, the petitioner agreed to pay Rs.85,000/- as full and final settlement. The petitioner has deposited a sum of Rs.57,000/- before the trial Court being the 50% of the fine amount and the remaining amount of Rs.28,000/- to be payable by the petitioner-accused to the respondent-complainant within 30 days from today (26.04.2025). 3 4. Both the parties have agreed to the terms of joint memo and duly signed by them and their respective counsel. 5. The respondent-complainant is permitted to withdraw the amount in deposit of Rs.57,000/- on proper identification. 6. In view of the joint memo, the petition stands disposed of and the petitioner-accused is acquitted for the offence punishable under Section 138 of Negotiable Instruments Act, 1881. In case of default of payment, the respondent- complainant is at liberty to take action in accordance with law. The Petitioner has already deposited amount of Rs.57,000/- (Fifty Seven Thousand only) in C.C.No.7859/2018 before the XVIII ACMM Court Bengaluru i.e. Trial Court. The respondent pray this Hon’ble Court direct the Trial Court to release the amount deposited by the petitioner before the Trial Court to the respondent and the petitioner has no objection to release the above said deposited amount of Rs.57,000/- (Fifty Seven Thousand only) in favour of the respondent. Further, the petitioner is agreed to pay remaining settlement amount of Rs.28,000/- (Twenty Eight Thousand only) within 30 days from this day. Hence, the petitioner and the respondent has agreed for the full and final settlement. Therefore, the petitioner and the respondent prays this Hon’ble Court to dispose the matter as per the compromise of Joint Memo.
