Order 04/02/2025
1. These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accused- petitioners have been arrested in connection with FIR
[2025:RJ-JP:4884] (2 of 3) [CRLMB-16043/2024] No.1055/2024, registered at Police Station Mansarovar, District Jaipur City (South), for the offence(s) under Sections 115(2), 126(2), 119(1), 333 and 310(2) of BNS.
2. It is contended by learned counsel for the petitioners that the accused-petitioners have falsely been implicated under Sections 115(2), 126(2), 134(4), 331(6) and 310(2) of BNS. It is argued that the accused-petitioners and the complainant-Kishan Mohan Rawat have arrived at compromise and the complainant do not want to pursue the criminal case registered against the accused-petitioners. The accused-petitioners are in custody since 25.11.2024 and 03.12.2024 respectively, the investigation/trial of the case may take considerable time and the injuries sustained to complainant Kishan Mohan Rawat was found to be simple in nature, therefore, these bail applications of the accused- petitioners may be allowed.
3. Learned Public Prosecutor has opposed these bail applications.
4.
Learned counsel Mr. Sameer Khan, appearing on behalf of the complainant and the complainant-Kishan Mohan Rawat himself is present in person before this Court.
5.
Learned counsel for the complainant has no objection, if the bail applications of the accused-petitioners are allowed.
6. Heard and perused the material available on the record.
7. Considering the above facts that the complainant has no objection regarding allowing of these bail applications, the accused-petitioners are in custody since long and trial of the case may take considerable time, without commenting anything on the
[2025:RJ-JP:4884] (3 of 3) [CRLMB-16043/2024] merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.
8. Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused- petitioners, namely; 1. Ravi Kalal @ Ravi Raj S/o Devilal and
2. Hemraj Saurot S/o Shri Chran Singh, in connection with FIR No.1055/2024, registered at Police Station Mansarovar, District Jaipur City (South), shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
