05/ 17.10.2025 This petition has been filed for modification of the order dated 16.05.2024, passed in A.B.A. No. 2551 of 2024 by this court.

Learned counsel appearing for the petitioner submits that this petition has been filed for further modification of the order dated 16.05.2024, passed in A.B.A. No. 2551 of 2024 by this court. She submits that in the said order, direction has been issued to the petitioner to surrender before the learned court within three weeks, however, the petitioner has not been able to surrender within the stipulated time. She further submits that earlier another Cr.M.P. No. 2070 of 2024 has been filed praying for extension of the surrender time, wherein further two weeks time was extended. She next submits that in spite of that the petitioner has not been able to surrender before the learned court within the extended time, since the petitioner was ill and he was advised to strict bed rest and to buttress her argument, she refers to Annexure-1 of the supplementary affidavit, which is the medical prescription of the doctor of Muzaffarpur (Bihar). On these grounds, she submits that further two weeks time may kindly be allowed to the petitioner to surrender before the learned court.

Learned A.P.P. appearing for the State submits that earlier once the opportunity was provided to the petitioner to surrender before the learned court by way of extension of time, in spite of that the

petitioner has not surrendered before the learned court.

Considering that the anticipatory bail has already been provided in favour of the petitioner, however, he has not been able to surrender within the stipulated period, due to the reason recorded in the submission of learned counsel appearing for the petitioner and further considering the prescriptions of the doctor, brought on record by way of filing the supplementary affidavit, as such, further one week time after Diwali vacation is extended to the petitioner to surrender before the learned court.

The order dated 16.05.2024, passed in A.B.A. No. 2551 of 2024 by this court is modified to the above extent and the rest of the conditions are kept intact.

With the above observation, this petition is disposed of.
