JUSTICE RAJIV ROY ORAL ORDER 2 07-05-2025 Heard the parties. 2. The petitioners are apprehending their arrest in connection with Katihar Nagar P.S. Case No. 870 of 2024 for the offence under sections 305, 319(2), 318 (4), 61(2) and 3(5) of the B.N.S. lodged on 18.11.2024 by the informant, Sujit Kumar Rai. 3. As per the prosecution story, the informant alleged theft of golden jewelries of the grand mother on the assurance of cleaning it. The jewelries were worth Rs. 80 to 90 lakhs and only after they ascertain the accused through CCTV footage, the role of the petitioners came. This led to the FIR. Patna High Court CR. MISC. Learned counsel for the petitioners submit that there is six days delay in lodging of the FIR, though they say that it resembles the accused, cannot confirm it. Lastly, the informant and the accused have come to a compromise. 5. Learned APP opposes the prayer submitting that firstly, they have criminal antecedent, secondly, their role have come in the CCTV footage, compromise cannot be a ground to stop the movement of wheels of investigation. 6. This Court is in conformity with the submissions put forwarded by the learned APP, admittedly, such kind of person who lure the old aged lady in the garb of cleaning the ornaments, it would be appropriate that the petitioners seek bail. 7.
