(Oral) Petitioner herein, who at present is working as Peon at GSSS Tatiyana, Education Block Kafota, District Sirmaur, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation (Annexure P-2), whereby he has prayed for his transfer from afore station to one of the stations, as detailed in the representation, on account of disability. 2. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call
for the reply from the respondents, who are otherwise represented by Mr. Vishal Panwar, learned Additional Advocate General. Mr. Panwar, states that though having taken note of the fact that petitioner has not completed normal tenure at present place of posting, there appears to be no justification to transfer him from present place of posting to one of the stations of his choice, but yet representation, if any, filed by the petitioner on the ground of disability shall be considered in accordance with the Transfer Policy formulated by the Government of Himachal Pradesh. 3. Since it is quite apparent from the pleadings adduced on record by the petitioner, which are duly supported by an affidavit that petitioner is physically disabled to the extent of 50% and his mother expired in the month of August, 2025 and there is none to take care of his 82 years old father, coupled with the fact that he has already served in District Sirmaur for more than five years, there appears to be no impediment in issuing direction to the respondents to consider and decide the representation of the petitioner (Annexure P-2) expeditiously, preferably within four weeks from today. Ordered accordingly.
Ordered accordingly. Needless to say, authority concerned, while doing the needful, in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass appropriate orders taking note of fact 2
