2. The challenge in this petition is to an order passed by the Appellate Forum constituted under the Khadi Village Industries Commission (KVIC), which is the Appellate Authority (Chairman of the KVIC) which is dated 12.12.2023. Against this order, an appeal has been provided under Section 19 of the Administrative Tribunals Act, 1985, since the KVIC is one of the statutory authorities that is covered under the provisions of that Act. Obviously, therefore, the Petitioner has an alternate remedy of an application provided under 25th September, 2025 S. N. Joshi Correction carried out as per order dated 01.10.2025 sd/- 2025:BHC-GOA:1907
WP 561 of 2024 Section 19 of the Administrative Tribunals Act, for which reason this petition is not being entertained and is rejected on maintainability.
3. From the record, it appears that the Writ Petition was filed on
18.04.2024. Even otherwise, if the period of limitation is taken under Section 21 of the Administrative Tribunals Act, if the same had been filed before the Appellate Forum, it would have been filed within the prescribed limitation of one year. The Administrative Tribunal may consider that this petition was filed within that period whilst disposing of an application for condonation of delay, which would be filed along with the appeal. Learned Advocate for the Petitioner submits that the appeal would be presented before the Administrative Tribunal within a month from today.
4. The petition stands disposed of, since there is an alternate remedy, after making the above observations.
