ORDER 20.02.2026 Complaint alleges non-compliance of this Court’s order dated 29.07.2025 entered by this Court in Complainant’s W.P.(C) No.14426 of 2025. The operative portion of the order reads as under:
“4. Learned AGA appearing for the official Opposite Parties opposes the petition contending that disputed facts are involved and therefore Petitioner be relegated to the Educational Tribunal. Having so contended, he agrees with the suggestion of this Court to instruct his jurisdictional clients to look into the grievance of the Petitioner in terms of the pleadings in the writ petition and in the light of the recommendation of the DEO, the copy whereof avails at Annexure-9, within a reasonable period. This is fair. In the above circumstances, the writ petition is
disposed of and time for compliance being fixed at three months, which would include the duty to discharge of duty to inform the result of such consideration to the Petitioner. It is open to the jurisdictional authority to solicit any information or document from the side of the Petitioner as are required for due consideration of his case. However, in that guise delay shall not be brooked.”
2. Learned AGA appearing in advance for the Contemnors has filed the order No.4924 dated 20.02.2026 accompanied by
Memo No.4892 dated 20.02.2026 to the effect that a sum of Rs.4,70,713/- for the subject period shall be paid towards arrears of claim of the Petitioner. The Memo also directs filing of compliance affidavit in this contempt petition. Learned AGA on being asked submits that the amount now sanctioned would reach the bank account of the Complainant within a period of three (3) weeks. Agreeing with this undertaking, this CONTC is dropped with liberty to the Complainant to seek its revival for aggravated contempt, if Undertaking is not adhered to. In the case of breach of Undertaking that would be aggravated contempt which may warrant levy of exemplary costs in thousands of rupees payable personally by the Contemnors in addition to other penal action.
