ORDER: (Per Hon’ble Sri Justice B. Krishna Mohan) Heard the learned counsel for the petitioner and the learned Central Government Counsel for the respondents.
2. This writ petition was filed questioning the orders of the Central Administrative Tribunal, Hyderabad Bench in OA/20/1123/2015 dated
14.03.2022. The petitioner seeks appointment under Liberalized Active Retirement Scheme for Guaranteed Employment for Safety Staff (LARSGESS). Since it was not considered by the respondent department, he filed O.A. before the learned Central Administrative Tribunal, Hyderabad Bench seeking necessary direction to the respondents therein to issue appointment letter to the petitioner herein/applicant therein as trackman on par with the others under the said scheme.
3. In view of the judgment of the Hon’ble Apex Court in Manjith & Others vs Union of India and another \n W.P.(Civii)No.78 of 2021 dated 29.01.2021 as it supported the decision of the Railway Board in terminating the said scheme, held that the said decision continues to stand. Accordingly, the said O.A. was dismissed. Assailing the same this writ petition was filed.
4. The respondents also filed detailed counter affidavit stating that the Hon’ble Supreme Court observed that all the claims based on the scheme must now be closed as per the Para No.6 of the said judgment.
