JUSTICE ANIL KUMAR SINHA ORAL ORDER 3 25-02-2026 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. 2. This application for grant of anticipatory bail, arises out of Sakra Police Station Case No. 138 of 2025, disclosing offences under Sections 80 and 3(5) of Bharatiya Nyaya Sanhita. 3. The prosecution case, as per the First Information Report, is that the daughter of the informant Patna High Court CR. MISC. No.68452 of 2025(3) dt.25-02-2026 2/4 was married to co-accused Ram Nivas Sahni in the year 2021, and after the marriage, the accused persons started torturing the daughter due to non-fulfillment of demand of dowry. The husband of the informant’s daughter was caught in an objectionable condition with his bhabhi, and when objected, the informant’s daughter was brutally assaulted by the accused persons. On 17.03.2025 the accused persons killed the daughter of the informant and her two-and-a-half- year-old baby and threw the dead body across the river. The informant was given information on 18.03.2025; thereafter, she arrived and lodged the FIR. 4. Learned counsel for the petitioners submits that the petitioners have not committed any offence in the manner alleged and they have falsely been implicated in this case. The entire family members have been made accused on the basis of general and omnibus allegations without any specific attribution of overt act. Petitioner No. 1 is the grandmother-in-law of the deceased and is about 81 years of age, Petitioner No. 2 is the gotini (co-sister) of the deceased, Petitioner No. 3 is the elder brother of the husband of the deceased (bhaisur), and Petitioner No. 4 is Patna High Court CR. MISC. No.68452 of 2025(3) dt.25-02-2026 3/4 the younger brother (dewar) of the husband of the deceased. The cause of death has been opined by the doctor asphyxia due to hanging. 5. Regards being had to the submissions made on behalf of the parties and taking into consideration the fact that the allegations against the petitioners are general and omnibus in nature, and the petitioners are other family members of the deceased—Petitioner No. 1 being the aged grandmother-in-law, Petitioner No. 2 being the gotini (co- sister) of the deceased, Petitioner No. 3 being the elder brother of the husband of the deceased (bhaisur), and Petitioner No. 4 being the younger brother of the husband of the deceased (dewar), I am inclined to grant the petitioners privilege of anticipatory bail. 6. This application is, accordingly, allowed. 7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Muzaffarpur, in connection with Sakra Patna High Court CR.
