Petitioner is seeking to enlarge him on bail in Crime No.240/2024 registered at Pulakeshinagara Police Station. - 3 - NC: 2025:KHC:4859 CRL.P No. 12648 of 2024 3. Charge sheet is filed against the petitioner for offences punishable under section 376(1) of Indian Penal Code, 1860 [for short 'IPC'], and Sections 3, 5(j), 5(j)(ii), 5(n), 6 and 8 of the Protection of Children from Sexual Offences Act, 2012 (for short, 'POCSO Act'). 4. The victim girl is aged 12 years 11 months. Petitioner is none other than her grand father. Case of the prosecution is that petitioner committed penetrative sexual assault on the victim during night hours due to which she became pregnant. Her fetus was medically terminated. As per DNA Report, petitioner is the biological father. As per Birth Certificate, date of birth of the victim is 25.07.2011. Hence, at this stage, a prima facie case is made out against the petitioner. Considering the nature and gravity of the offence, this is not a fit case to enlarge the petitioner on bail. Further, evidence of the victim girl is yet to be recorded.
