The present applicant ‘Shahnawaz Ahmed’ S/o Nasir Ahmed is praying for regular bail in relation to First Information Report dated 31.05.2023 bearing Case Crime No. 0025 of 2023 P.S. Bhatrojkhan, District Almora, wherein, the present applicant has been implicated for the offence punishable under Section 2/3 of the Uttar Pradesh Gangsters and Anti Social Activities (Prevention) Act, 1986. 4. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and earlier he was also implicated in two other cases, the reference of which has been given in paragraph 4 of the bail application, in which he was already bailed out. 5. Apart from this, he categorically stated in paragraph 7 of the bail application that while he was in custody he was absconded and thereafter he himself has surrendered. 6. On the other side, the respondent/ complainant submits that the applicant have a criminal history and it is a very serious issue that while he was in custody he himself ran away. 7. After hearing the argument of learned counsel for the parties and further taking into consideration the past history of the applicant and also the subsequent conduct of the applicant while he was in custody, this court does not find any merit in the bail application. 8.
