COMMON ORDER:
The instant Criminal Petitions are filed under Section 482 of the Code of Criminal Procedure, 1973, by the Petitioners/Accused Nos.2 and 3, to quash the proceedings against them in C.C.Nos.1084 and 1085 of 2022 respectively on the file of the Court of Judicial Magistrate of First Class, Yemmiganur,
2 Kurnool District for the offences under Sections 138 and 142 of the Negotiable Instruments Act, 1881. 2. None appeared for the Petitioners. 3. Sri Varun Byreddy, learned counsel for Respondent No.2 would submit that, they are conceding to the contentions raised by the Petitioners in the present cases and the cases may be quashed against the Petitioners/Accused Nos.2 and 3. Learned counsel would further submit that, relating to the amount due from Accused No.1, the Complainant obtained cheques in discharge of the said debt and as the same was dishonoured, the present complaints have been filed by Respondent No.2/Complainant against Accused Nos.1 to 3. Learned counsel would further submit that, even in the absence of the Petitioners/Accused Nos.2 and 3, the cases can be proceeded against Accused No.1. It is submitted that the Petitioners herein are no more partners of M/s.V9 Enterprises, Kadapa. As such, the cases may be quashed against the Petitioners. 4. Recording the same, the Criminal Petitions are allowed and the proceedings against the Petitioners/Accused No.2 and 3 in C.C.Nos.1084 and 1085 of 2022 respectively on the file of the Court of Judicial Magistrate of First Class, Yemmiganur, Kurnool District for the offences under Sections 138 and 142 of the Negotiable Instruments Act, 1881, are hereby quashed.
