The petitioners are aggrieved by the fact that inspite of specific complaint being made relating to forgery of documents with the object of misappropriating the family assets, no steps have been taken by the Officer-in- charge of Taltala Police Station and/or the superior officers of police.
The records of the case reflect that information was furnished on or about 9th April, 2024.
Since the complaint of the petitioner before the Commissioner of Police and the Officer-in-charge of Taltala
Police Station did not yield any result, the petitioner would be at liberty to approach the jurisdictional Magistrate by way of invoking the provisions of Section 175(3) of the BNSS. The learned Magistrate would assess and ascertain the genuinity of the accusations, thereafter, pass necessary directions as he deems fit and proper.
As none appears on behalf of the State, Ms. Neelam Singh, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. Her appearance may be regularized by the concerned authorities.
With the aforesaid observations, WPA 18771 of 2024 is disposed of.
