ORAL ORDER (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA)
Following are the directions in the order dated 04.01.2024 passed by learned Single Judge while disposing of the writ petition,
"(ii) The impugned order vide Annexure-G issued by respondent No.2 insofar as reserving the single post of Lecturer in English to be filled up by a candidate belonging to Scheduled Tribe and the single post of Lecturer in Chemistry required to be filled up by candidate belonging to Scheduled Caste is hereby set aside;
(iii) The petitioner-Institution is hereby permitted to fill up the single post of Lecturer in English and Chemistry by inviting applications through open competition;
(iv) If after following due recruitment process, appointments are made, concerned respondents are hereby directed to consider the said appointments with grant-in-aid."

which was dealt with in the same order by learned Single Judge, however, in that case, the subject involved was English on the post of which Lecturer was to be appointed.
3. The order dated 15.01.2025 passed in the said contempt petition reads as under,
"2. A bare reading of the aforesaid directions disclose that while learned Single Judge permitted the petitioner-Institution to proceed with the recruitment process by inviting applications through open competition in respect of the post in question. It was further directed that the respondents concerned shall consider such appointments with grant-in-aid. However, for this exercise, no time limit is provided.
3. In that view, it is not possible to conclude at this stage that the respondents have committed any contempt of Court much less willful contempt.
4. At the same time, the directions of the Court should not go uncomplied with.
5. Therefore, by providing that respondent No.2 shall take necessary steps as contemplated in the aforesaid directions of learned Single Judge within two weeks, this contempt petition is disposed of."
