1. Heard learned counsel for the parties.
2. The present writ petition has been filed for the following reliefs :-
“(a) for issuance of an appropriate writ(s) / order(s) / direction(s) commanding upon the respondents to forthwith release the Bonus amount as per the Agreement dated 22.04.2013 because the petitioner has already completed the whole work prior to the intended completion schedule and as per Clause 50 of the Contract which provides for Incentive Bonus payment for early completion of work and Clause 11 of the Agreement clearly stipulates that "if the work - 1 - W.P.(C) No.1786 of 2024
2025:JHHC:31904 is completed before time, maximum 6% bonus will be paid" and hence the petitioner is eligible for bonus amount; (b) for issuance of appropriate writ(s) /order(s) / direction(s) commanding upon the respondents to pay interest on the Bonus amount from the date of completion certificate is issued to the petitioner on 20.07.2015 that the petitioner has successfully completed the work prior to the intended completion schedule.”
3. It has been submitted by the learned counsel for the petitioner that there is admitted dues.
4. However, the counter affidavit has been filed on behalf of the respondents, wherein in para – 12 it has been stated that the work has not been completed.
5. It is a disputed question of fact and further when there is non-completion of work, there cannot be any admitted dues.
6. In that view of the matter, I do not find any reason to entertain the present writ petition. Accordingly, it is, hereby, dismissed.
7. However, the petitioner is at liberty to work out his remedy in accordance with law.
8. Pending interlocutory application, if any, stands
disposed of.
