JUSTICE ANIL KUMAR UPMAN Order 10/01/2025
1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.807/2024 registered at Police Station Mathuragate, District Bharatpur (Raj.) for the offences punishable under Sections 103(1) & 61(2)(a) of BNS. Later on, police filed charge-sheet in the matter for the same offences. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Counsel submits that entire prosecution case is based on circumstantial evidence and from the perusal of charge-sheet it reveals that no incriminating circumstances are appearing against the petitioner. Counsel submits that in the charge-sheet, prosecution failed to establish the motive of the petitioner. Counsel submit that the stone which was allegedly used in
[2025:RJ-JP:1598] (2 of 2) [CRLMB-16270/2024] committing murder and recovered at the instance of petitioner is of no use because same has been recovered from the open place which was accessible to everyone. Counsel further submits that there are no criminal antecedents of the petitioner. Petitioner is in custody since 08.10.2024. Further custody of the petitioner would not serve any fruit purpose. 3. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner. She submits that it is evident from the charge-sheet that lastly petitioner was found in company of the deceased which is evident from the CCTV footage collected from the railway station and thereafter, deceased was not found alive. She submits that recovery of stone which was used in committing murder of deceased, has also been made at the instance of the petitioner from the bushes near the place where dead body was recovered and as per FSL report, human blood was also found on the said stone. 4.
Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties and material available on record in the form of charge-sheet; gravity of offence, I do not find it a fit case to allow this bail application, at this stage. 5. Accordingly, this bail application stands dismissed. However, observations made herein are only decision of this bail application and would not have any impact on the trial of the case.
