Petitioner seeks work charge status w.e.f. 23.07.2002 on notional basis with further prayer to release actual benefits on account of conferment of work charge status with effect from the date of his joining on work charge basis, i.e. 31.10.2011. Though the petitioner has highlighted certain factual position concerning litigation carried out by him, however, learned counsel for the petitioner fairly submits that in view of definitive pronouncement of the Hon’ble Apex Court in The 1 Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 Himachal Pradesh State Electricity Board Ltd. & Anr. Vs. Nanak Chand & Ors.2, the case of the petitioner is required to be considered by the respondents keeping in view the aforesaid decision. Learned counsel further submits that the petitioner would be content in case the respondents are directed to consider his case in light of the aforesaid judgment within a fixed time schedule. Learned counsel appearing for the respondents is not averse to this prayer. 3. Having regard to the afore-submissions, but without examining the merits of the matter, this writ petition is disposed of with a direction to the respondents/ competent authority to consider and decide the case of the petitioner in accordance with law as well as taking into consideration the above judgment in the case of Nanak Chand2 by passing appropriate order, within a period of six weeks from today. The decision so arrived at shall also be communicated to the petitioner. The writ petition stands disposed of in the above terms, so also the pending miscellaneous application(s), if any.
