Also heard Mr. Bhaskar Sarma, the learned Additional Public Prosecutor, Assam as well as Ms. M K Brown, the learned Amicus Curiae representing the respondent No.2.
2. This is an application under section 482 of the BNSS, 2023 praying for grant of pre- arrest bail in respect of Goroimari P S Case No.71/2025.
3. Pursuant to the interim order granted by this Court on 08.01.2026, the petitioners Rukiya Khatun and Abdul Barique @ Abdul Barek, they have already appeared before the Investigating Officer and have been cooperating with the investigation.
4. I have considered the submissions made by the learned counsels of both sides.
5. Since the petitioners have been cooperating with the Investigating Officer, they do not deserve to be detained in custody.
6. For that reason, Anticipatory Bail Application of the petitioners is allowed.
7. The interim bail granted to both the petitioners Rukiya Khatun and Abdul Barique @ Abdul Barek by this Court on 17.09.2025 is hereby made absolute.
8. With the aforesaid direction, the Anticipatory Bail Application stands disposed of accordingly. The CD shall be returned. JUDGE Comparing Assistant
