Mr. Joydeep Roy Mr. Debarshi Brahma …..For the State This is an application under Section 401 read with Section 482 of the Code of Criminal Procedure filed by the petitioners for quashing of the proceeding being Burdwan Women Police Station Case No.126 of 2015 dated 5th June, 2015 under Sections 354 / 354B / 354C / 324 / 506 / 34 of the Indian Penal Code now pending before the learned Chief Judicial Magistrate, Burdwan and all orders passed therein including the order taking cognizance and the order dated 30th March, 2015 in G.R. Case No. 1821 / 15/ F. I. R. Case No. 480 of 2015 allowing the petition of the opposite party Rupa Das dated 30th March, 2015 under Section 156(3) of the Code of Criminal Procedure. The matter was dealt with by a Co-ordinate Bench of this Court and on 4th May, 2016 when the order of stay of all further proceedings for a period of ten weeks or until further orders, whichever is earlier was passed by the Hon’ble Court, which was subsequently extended till 23rd August, 2016. Since, thereafter, the petitioner has not taken any step to proceed with this matter. However, the learned advocate for the petitioner appeared before this Court on 20th September, 2024 and after that on 20th March, 2025.
2 Today, Mr. Joydeep Roy, learned advocate appeared on behalf of the State. In view of the long pendency of the matter and in absence of any interim order for such a long period, this Court is of the view that there is no reason to keep the matter pending any further. Accordingly, criminal revisional application being, C.R.R. 2315 of 2015 stands dismissed for default. Let a copy of this order be sent to the Trial Court below by the Department forthwith. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon’ble Court.
