Order on Board 16/07/2025 1 This first anticipatory bail application under Section 482 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No.255/2023, registered at Police Station – Takhatpur, District – Bilaspur (C.G.) for the offence punishable under Sections 4, 6, 10 of Chhattisgarh Agriculture Cattle Preservation Act, 2004 and Sections 11(1)(a) and 11(1)(d) of Prevention of Animal from Cruelty Act. 2 2 The prosecution case in brief, is that, on 24.05.2023, Police Officers from Takhatpur Police Station, who were on night patrol duty, received information about the transportation of cattle to a slaughterhouse. They proceeded to Araiband Khar, where the Hindu Raksha Dal, Bilaspur (C.G.), had stopped a truck (No. C.G.-15/DG/1525) and a container No. (B.P. 13 BL 7401). During the search, 72 buffaloes were seized from the vehicles. An FIR was subsequently lodged against the driver, owner of the vehicles, and the applicant under Sections 4, 6, and 10 of the Chhattisgarh Agriculture Cattle Preservation Act, 2004, and Sections 11(1)(a) and 11(1)(d) of the Prevention of Cruelty to Animals Act. 3
Learned counsel for the applicant submits that the applicant is innocent and falsely implicated in this case. He further submits that during the course of incident no any cattle’s have been seized from possession of the applicant. Further, the applicant has two previous criminal antecedents of similar nature, which are still pending. Hence, he prays for grant of anticipatory bail to the present applicant. 4 On the other hand, learned counsel for the State opposes the bail application and submits that a large number of cattle were found, brutally loaded in truck, taken to slaughter house for slaughtering. Further, the anticipatory bail application of the co-accused, namely, Nadeem Kuraishi, has already been rejected by this Court vide order dated 19.07.2024 passed in MCRCA No. 803/2024. Further, the applicant has two previous criminal antecedents of similar nature. Therefore, he is not entitled to be granted anticipatory bail. 5 I have heard learned counsel appearing for the parties and perused material available on record.
3 6 Taking into consideration the facts and circumstances of the case, nature of allegation made against the present applicant, and the fact that a large number of cattle were found, brutally loaded in truck, taken to slaughter house for slaughtering, further, the anticipatory bail application of the co-accused, namely, Nadeem Kuraishi, has already been rejected by this Court vide order dated 19.07.2024 passed in MCRCA No. 803/2024, and also considering the fact that the applicant has two previous criminal antecedents of similar nature, as such, this Court deems it appropriate to reject the anticipatory bail of the present applicant. 7 Accordingly, the Anticipatory Bail application of applicant - Rahul Chauragade involved in Crime No.255/2023, registered at Police Station – Takhatpur, District – Bilaspur (C.G.) for the offence punishable under Sections 4, 6, 10 of Chhattisgarh Agriculture Cattle Preservation Act, 2004 and Sections 11(1)(a) and 11(1)(d) of Prevention of Animal from Cruelty Act, is rejected.
