Order 06/01/2025
1. These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have
[2025:RJ-JP:698] (2 of 3) [CRLMB-16261/2024] been arrested in connection with FIR No.217/2024 registered at Police Station Kethwada, District Deeg for the offence(s) under Sections 303(2), 317(2), 319(2), 318(4), 338, 336(3), 340(2) & 61(2)(a) of BNS and Section 66D of IT Act.
2.
Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the matters are exclusively triable by Magistrate. The accused-petitioners are in custody since long and the trial/investigation of the case may take considerable time, therefore, the bail applications of the accused-petitioners may be allowed.
3. Learned Public Prosecutor vehemently opposes the bail application.
4. Heard and perused the material available on record.
5. Considering the fact that these matters are exclusively triable by Magistrate and trial/investigation of the case may take considerable time, thus, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.
6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely
1. Rahul S/o Ahmed, 2. Laden S/o Hajar Kha & 3.
