Mr. Rangil Singh, Advocate, for respondent No.4. __________________________________________________________ Sandeep Sharma, Judge (oral): Being aggrieved and dissatisfied with the communication dated 04.03.2025 (Annexure P-2), issued under the signatures of Senior Audit Officer, Office of Principal Accountant General (A&E), Himachal Pradesh, Shimla, whereby direction came to be issued to District Treasury Officer, Shimla, Himachal Pradesh, to stop pension of the petitioner, petitioner has approached this Court in the instant proceedings, praying therein for following main reliefs: i) That the direction may kindly be issued to the respondents to release the pension to the petitioner from the due date in the interest of justice. ii) That the Respondents may kindly be directed to pay/release the pension to the petitioner with interest @ 12% per annum. iii) That the Respondents may further be directed to withdraw the communication vide dated 04.03.2025 (Annexure P-3) issued to the Respondent No.4. 1Whether the reporters of the local papers may be allowed to see the judgment? 2 2. Respondents have filed reply. Mr. Rangil Singh, learned counsel representing respondent No.4, while referring to the reply filed by afore respondent, submitted that letter dated 04.03.2025 was issued to the District Treasury Officer, Shimla, to withhold the pension of the petitioner till further orders, with copy to Principal, GSSS, Kaflah, District Shimla, Himachal Pradesh, seeking clarification regarding age of the petitioner, however, on receipt of clarification of retirement age of other similar situate person, the pension of the petitioner has been restored by communicating to the District Treasury Officer, Shimla, vide communication dated 22.05.2025. Since pension of the petitioner has been restored, grouse, as has been raised in the instant petition, stands redressed. 3. In view of the above, nothing remains to be adjudicated in the instant petition and as such, same is disposed of, with the direction to District Treasury Officer, Shimla, to ensure that arrears on account of withholding of the pension, if any, are released expeditiously, preferably, within a period of one month and thereafter petitioner herein shall keep on getting pension regularly.
