[2025:RJ-JP:2110] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 680/2025 Prithviraj Daukiya @ Prince Daukiya S/o Sh. Virmaram, Aged About 26 Years, R/o Daukiyo Ki Dhani, Village Karaliya, Bera, Station Gida, District Balotra, Rajasthan (At Present Confined In Central Jail, Jaipur). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Arpit Dotasra Mr. Mohit Sharma For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 15/01/2025 1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.28/2023 registered at Special Crime and Cyber Crime Police Station, Commissionerate Jaipur, District DCP Crime Commissionerate, Jaipur for the offences punishable under Sections 420, 406 & 120B of IPC and Sections 43, 66 & 66C of Information Technology (Amendment) Act, 2008. During investigation, offences under Sections 420, 406, 467, 468, 471 & 120B of IPC and Sections 43/66 & 66C of Information Technology (Amendment) Act, 2008 have been found proved against the petitioner. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. [2025:RJ-JP:2110] (2 of 3) [CRLMB-680/2025] Counsel submits that alleged offences are triable by Magistrate. Other co-accused persons, namely, Ashok Rinwa, Joginder Singh, Pradeep Kumar, Satyaprakash have been granted bail by this Court and co-accused Rohit Goyal and Dhiraj Singh have been given benefit of bail by Co-ordinate Bench of this Court. It is submitted that except one case, no other case has been registered against the petitioner and in that case, petitioner is on bail. Petitioner is in custody since 19.12.2024. Trial will take time in its conclusion and further custody of the petitioner would not serve any fruitful purpose. 3. Learned Public Prosecutor opposes the submissions made by the counsel for the petitioner. He submits that the matter pertains to online fraud. 4. I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the petitioner, especially the fact that alleged offences are triable by Magistrate; other co-accused persons have been granted bail as also looking to the custody period, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application. 6. This bail application is accordingly allowed and it is directed that accused-petitioner Prithviraj Daukiya @ Prince Daukiya S/o Sh. Virmaram, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the [2025:RJ-JP:2110] (3 of 3) [CRLMB-680/2025] satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 7. It is made clear that the accused-petitioner shall mark his presence in the first week of every month, till trial is concluded. If breach of this condition is reported or come to the notice of the Court, the same shall alone be a reason for the trial court to cancel the bail granted to the petitioner by this Court.
